LIMITATION OF LIABILITY AGREEMENT
IMPORTANT: This is a limitation of liability agreement. By using our Service, you agree to the strongest possible disclaimer of warranties and limitation of liability as outlined in these terms.

By accessing or using the SiteScribe mobile application ("Service") provided by SiteScribe Technologies LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.
2. Description of Service
SiteScribe is a mobile application that allows trade professionals to create professional reports using voice recordings and photographs. The Service converts user input into formatted PDF reports for insurance and client documentation purposes.
3. AS-IS SERVICE - NO WARRANTIES
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
4. NO GUARANTEES
SiteScribe Technologies LLC does not guarantee that the Service will be:
- Uninterrupted, timely, secure, or error-free
- Free from viruses, malware, or other harmful components
- Accurate, reliable, or complete
- Available at all times or in all locations
- Compatible with all devices or operating systems
5. USER RESPONSIBILITY
YOU ARE SOLELY RESPONSIBLE FOR:
- The accuracy and completeness of all reports generated through the Service
- Your interactions with clients, insurance companies, and other third parties
- Compliance with all applicable laws, regulations, and industry standards
- Maintaining appropriate professional licenses and certifications
- Backing up and securing your data
- Verifying the accuracy of all generated reports before submission
6. LIMITATION OF LIABILITY
IN NO EVENT SHALL SITESCRIBE TECHNOLOGIES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR FOUNDER BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, DATA, OR USE
- BUSINESS INTERRUPTION OR LOSS OF BUSINESS OPPORTUNITIES
- DATA BREACHES, DATA LOSS, OR UNAUTHORIZED ACCESS
- ERRORS OR INACCURACIES IN GENERATED REPORTS
- CLAIMS BY THIRD PARTIES, INCLUDING CLIENTS OR INSURANCE COMPANIES
- ANY DAMAGES EXCEEDING THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE PRECEDING 12 MONTHS
7. Indemnification
You agree to indemnify, defend, and hold harmless SiteScribe Technologies LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
8. User Conduct
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Violate any applicable laws or regulations
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to the Service
- Upload malicious code or harmful content
- Impersonate any person or entity
- Share your account credentials with others
9. Subscription and Payment
The Service may require payment of subscription fees. All fees are non-refundable unless required by law. We reserve the right to change pricing with 30 days' notice. Payment processing is handled by third-party providers subject to their terms.
10. Termination
We may terminate or suspend your account at any time for violation of these Terms or for any other reason. You may terminate your account at any time. Upon termination, your right to use the Service ceases immediately.
11. Intellectual Property
The Service and its content are protected by copyright, trademark, and other intellectual property laws. You retain ownership of your data and content, but grant us a license to use it to provide the Service.
12. Privacy
Your privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware, and you consent to personal jurisdiction in such courts.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms constitute the entire agreement between you and SiteScribe Technologies LLC regarding the Service and supersede all prior agreements.

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE, INCLUDING THE LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES PROVISIONS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.
